Do I have a case?

In August of 2001 my boyfriend and I signed a one year lease on a rental house together. He moved out in March of 2002, leaving me a letter stating that he would still pay his half of the rent til the lease was up and I still havent seen one penny.I have all the legal documents proving he hasnt paid. Do I have a good case against him in small claims court or am I wasting my time?

Hi, I have received a copy of your rent question. You have a good case against your ex. You can sue him for one half of the balance of the lease if you stay in the apartment or 1/2 of what you have to pay the owner if you leave the apartment. You have to sue him in the area that he lives, not the area that you live in. Remember that both you and the apartment owner have a duty to "mitigate your damages." That means that you and the apartment owner have to do your best to find a way to get a new tenant in, either as your roommate (what you need to do if you decide to stay) or as a replacement to you (if you decide to leave.)
