Cigarettes and minors.

If I were to provide pornography to a 13

year old, I could be charged for such. If

a parent smokes in a car with their 2

year old inside, how does that not

constitute providing tobacco to a minor?

that's just the law. and the law doesn't define "providing tobacco to a minor" as smoking in their presence.

That analogy does not make sense. If you give porn to a 13 year old then you get charged for it. If you smoke in a car you're not contributing to the delinquency of a minor because you never actually gave the tobacco to the minor.

It's illegal to provide minors with tobacco. The legislature has not made it illegal to smoke in the presence of minors.
