class action suit

there was a class action suit filed against the city of dearborn heights by the homeowners of a neighborhood in which the basements flooded back in '98.the city ended up paying each of the homeowners in the suit $21,000 ,admitting responsibility for the sewerage backup.I was one of the homeowners when the flood occured,but I was never aware that the suit was even filed.Is there any sort of action i can take to claim my fair share or am I s.o.l. Any sort of information would help. Thank You

Re: class action suit

A class action requires the plaintiff to send notice to potential class members giving them a chance to opt out. Assuming that you did not receive notice as set forth by the court, you may be able to file a separate action.

Most likely, if the matter was settled, the court was satisfied that you did receive notice and failed to timely respond.
