Legal Question in Civil Litigation in Michigan

I had cosigned for a credit card and the primary card holder decided to stop paying. I didn't find out until she had missed several payments and have caught the bill up. Do I have to pay off the balance before I can proceed with a legal claim? If I continue to make payments as is the amount will exceed small claims under michigan law.

When you cosigned, you agreed to be responsible for the charges made on the account. What is your legal claim? It's time for you to close the account.
