Damages from Collision with Drunk Driver
My daughter was involved in a collision with a drunk driver. The other driver was taken away in handcuffs. Nobody was injured in the collision, however our car was deemed a total loss. I am now in a position where I am offered $4500 for a car that I owe $7200 on. Do I have a right to collect this difference from the other driver?

Unfortunately in Michigan, you can only get $500 from him if you have a $500 deductible. There is no specific penalty for being drunk. However, what you can do, is go to court and talk to the prosecutor and judge on his trial date and tell them to make your reimbursement part of any deal they make him on the drunk driving case. Make it a term of probation and if he does not pay, that would be a probation violation. William S. Stern
