Legal Question in Civil Litigation in Michigan
My daughter was sued by the business she worked at for taking money from the cash register. Did they have proof? No. She doesn't have any money and the public defender ran her through the path of least resistance, which was conviction. The detective made her sign a confession. She of course now owes > $34k because there was no defense and because a detective wore down a 20 year old naive girl, good for him. $34k to a 20 year old is a life changing amount! Now she has no job and no way to pay the court imposed penalty.
Is there any way to get out of this position? She is being forced to pay $50 a month while having no job. Can she declare bankruptcy? Is there a legal remedy?

From the sound of it, it sounds like she has been ordered to pay restitution as part of the criminal plea. The only way around this would be to ask for a new trial based upon ineffective assistance of counsel. This would be very difficult since she signed a confession. From the amount involved, it is more than just taking a couple of bucks from a cash register. It sounds like a long term embezzelment. William S. Stern
