Employer is taking money from me for benefits but benfits have been cancelled

I have worked for a a doctor's office for 12 years and they provide us with medical benefits and a 401k plan. I am preganant and due at the end of July. I am involed in our office health care plan and 401k plan in which they take money from my check weekly for these plans. However, back in January I recieved a letter from my insurance company stating that my policy had been dropped back in November of 2001 because it was not paid. i am a high risk pregnancy patient and been having treatment since August for my pregancy. When I questioned my boss he told me that they were getting it reinstated retroavtively and that all will be fine. Well I know that you can not retroactiveate a policy that has been terminated for non payment. Nothing has been done about out health care and I keep asking and I keep getting the brush off, but they keep taking my money. Same thing with my 401k they keep taking my money out every week but they are not sticking it in my 401k and when I ask where is it, they just blow me off and tell me that they are sending a check soon. Please help me. What legal ground do I have?

It would be well worth your while to collect your information (paperwork) and take it to an attorney to review. There are a number of things that can done both civilly and if the money is not being properly directed to your 401K possible administrative sanctions. I think it would be well worth the consultation with an attorney to let him or her review the file.
