Legal Question in Civil Litigation in Michigan

expungement of misdemeanor charges to enter military

My son wants to join the National Guard. He's 23 now. When he was 18 and a senior in high school he had 2 misdemeanor charges. 1 for possession of marijuana and 1 for destruction of personal property. his recruiter is telling him he has to have his charges expunged before they will accept him. How does this procedure work? How long does it take and what are the approximate costs?

he is infortunately out of luck. You can only have one conviction ever to have it expunged. 2 or more convictions leaves you without help. www.kliszlaw.com

Where were your son's convictions. He is not eligible for an expungement with two convictions, but I have been successful in similar circumstances with a different strategy.

Call if you would like.

Your son should go to the clerk of the court that convicted him and get copies of his Order of Judgment and his Completion or release from probation.

It's very likely that he was placed on probation for possession of marijuana under section 7411 and placed on probation for MDOP under HYTA.

If this is so, then, if he successfully completed probation, he has no record of convictions and expungement is unnecessary.

Get the records first, and if he has any questions, email me.
