Legal Question in Civil Litigation in Michigan

False Billing By Company

Around 12/08/08 I received a letter from a collection agency stating I owed Detroit Edison $89.42. I told the collection agency and Detroit Edision that I have not lived in Michigan for ten years. After a lot of calls and letters I find out what the address is and it belongs to my son. I tried to explain this to Detroit Edison twice. They have not gotten back to me and when I talk to someone about it they say I am yelling and hang up. I tried to give them my son's new address and phone number and that is when they hang up again. This has appeared as a negitave in all three credit agencies and it is affecting my credit. How can they do this without conformation of facts? I need help.

Re: False Billing By Company

You need to put your communications in writing to the collection agency and DTE, otherwise it is your word against them. You should also write to the three credit reporting agencies to advise them that you are disputing the item on your credit report, and why. Have you talked to your son about this? Did he put the utilities in your name without your knowledge? If so, he could face criminal charges. I would suggest you talk to your son and have him pay the bill. However, you should still dispute the negative entries on your credit report if they are not legitimate.
