Legal Question in Civil Litigation in Michigan

Financial Obligation

Greetings:

My nephew broke up with his girlfriend at the end of last year. There is an item, a car radio/DVD player, that she bought for him, at the time it was considered a gift. She had put the purchase on her credit card. She is now threatening him with small claims court, saying he is in obligation to pay half of the cost of this item.

Should he worry?

Re: Financial Obligation

No.

She gave those things to him as a gift, he is NOT required to pay for them any more than he would be required to pay for a birthday present.

Re: Financial Obligation

Your nephew's girlfriend would generally have to be able to show that a contract existed to prevail in court. There is no obligation as regards a gift. If you have any questions, please contact me at www.lawgreg.com
