Legal Question in Civil Litigation in Michigan
Gift of money
My lover gave me money and bought me things thru out our 2 and half year relationship. She put $3000.00 down on my new car and did not ask for repayment of this, the check was written to the dealership along with my trade in. Also she wrote me a check for $5000.00 that I used to pay off debts she told me I didn't have to pay this back but I said I would pay off what I could on the $5000.00 I paid $1400.00 in cash, also if their were gift things within the family I would say well we will take off your half of the gift on the money. (example x-mas gifts total $500.00 I pay for them all and her half $250.00 would come off the orignal $5000.00. We have now broke up and she is saying I owe her $6700.00 this includes the $3000.00 gift at the car dearlership and doesn't include all payments, like the x-mas gift that I have no real receipts for. We had no contract signed she makes 4 times what I do and always paided for everything thru out the relationship. Does she have a case? I feel the money was a gift. The money was given early in the relationship Sept 2002.

Re: Gift of money
If she sues it is a matter of what she can prove. She has the burden of proof so that is in your favor. Perhaps the judge would determine some things are gifts and other things not gifts. It will be up to the judge. Bill Stern 248-353-9400
