Legal Question in Civil Litigation in Michigan

HOA Responsibilities

A tree within Common Area adjacent to my home was in danger of falling. I notified my HOA and over 2 weeks went by with no action. Fearing for my family's safety, I paid a company to remove the tree in the Common Areas for $1500.

In Michigan, can the HOA be made to reimburse me for this?

Re: HOA Responsibilities

It depends on the rules of your HOA and whether 2 weeks is considered a reasonable amount of time for you to give them notice and for them to correct the problem. In some cases, it might have been enough time, others it may not have - depends on the urgency of the situation. In either case though, as long as the HOA agrees that the tree needed to be removed, they would have had to pay for it, so you should get reimbursed. They might dispute the amount, saying they could have had it done cheaper, etc., and so that you are responsible for anything above what they think is reasonable.
