Hotel Negligence
My daughter experienced full respiratory arrest while staying in a hotel in Muskegon, MI. She was found in the lobby not breathing by her Aunt. No one from the hotel was present to assist her while she lye there unconcious. To add insult to injury, when the hotel clerk appeared, and was asked to dial 911, he pointed to the lobby phone. Her aunt could not dial out because she was unfamiliar with the fact that she had to dial a 9 first. I am in an uproar! Does the hotel have any responsibility to make the call to 911 when asked? I also think her breathing problem was caused by a heavy chlorine leak in the building. What can we do?

You could file a personal injury claim against the hotel, but you'll haveto take the particulars to a local attorney who can look at the facts and give you a better idea of your options.

Ms. Mullen, I have reviewed your e-mail regarding the incident that befell your daughter. While normally there is no duty to be a "good Samaritan", that situation changes if you have put a person in a position of peril. Therefore it is important to know why your daughter suffered a respiratory arrest. If the condition was caused by the hotel (you suggest that it was due to a chlorine leak)then there is a duty on the part of the hotel to assist your daughter.
