Legal Question in Civil Litigation in Michigan

possible lawsuit

I am going through a nasty break-up with a co-worker. We both work in EMS, He is stationed out of a hosp. I had knowledge and evidence that he was stealing drugs from the hosp. I went to hosp security, I told them I would be fired if my employers knew I had come to him. He assured me, my name would be left out of it. The next day he contacted my employers, and I was fired. The reason; because I went to hosp jeopardizing their contract with them. Do I have a possible lawsuit against the hosp, or the head of security?

Re: possible lawsuit

On the one hand, you may have a claim for retaliatory discharge based upon public policyu preventing discharge of at will employees under certain situations where the public should be protected when an employee goes forward to report illegal activities. Ohter the other hand, it does not come within the protection of the Whstle Blowers Protection Act because you did not go to a public authority. If you went to the police instead of hospital security, you would be protected under the Whistleblowers Protection Act. Furthermore, they may have discharged you because you knew of the illegal activity for some time but only reported it because of the breakup. So you may have an arguable claim but it surely is not clear cut. I'd have to know more details to give you a better answer. If you want to discuss it, give me a call. William S. Stern
