Legal Question in Civil Litigation in Michigan

Malicious Prosecution? Wrongly accused!

Last year 2004 I apparently wrote a check that bounced. March 14th, 2005 I received in the mail a letter from the police department saying I had 5 days to pay, or have a warrant issued. I paid THAT DAY. I got a receipt saying I paid. Wednesday, 4/20/2005 I received another letter from the P.D. saying I had a warrant for non payment. The company I had written the check to told the P.D. that I had NOT paid it as of 4/1/05, I still have the receipt!! I had to be finger printed, arraigned, and am now out on 500.00 bond! I have to go to pre trial 5/24/05. I have NEVER even had a traffic ticket and now I have a misdemeanor on my record? I was told this will be on my record even when it gets dismissed (it better get dismissed!). This isnt fair to me. I am in college going into Human services, where a back ground check will be required. What can I do about this? I am mad. The check was for 17.00, and I PAID it. I dont know where to go with this, or who to talk to. ANY help would be appreciated. I am very proud of not having a record, I am a model citizen in my opinion. Also, if I have to pay fines/ court costs, I dont feel I should have to pay them. I guess I am asking if I can sue the company that did this to me?

Re: Malicious Prosecution? Wrongly accused!

I need more information before I can give you an appropriate answer. It does not seem that bouncing a $17.00 check should result in police involvement. However, I believe that the police can ask for a warrant. Having said that, I am amazed they would prosecute for $17.00. I have been involved in these types of cases before, but for quite a bit more money. Please call me at (248) 679-1552 for more information.
