Legal Question in Civil Litigation in Michigan

pro se litigation and cost recovery

I have filed a pro se civil complaint in the 84th district court covering a boundary dispute and the building of a fence with nunance, anticipitory trespass, and invasion of privacy as cause of action. I believe that I ahve good law and precidence but was wondering about the recovery of costs. I relize that I can not ask for attorney fees but can I ask to be paid what a leagle reaseacher or para legal is paid? If so is thjere case law governing such a request.

Mr. Stern is correct.

First, you have filed in the wrong court. Property disputes are equitable and matters of equity are typically heard (with very few exceptions) in the circuit court.

Attorney fees are not recoverable unless (1) there is a statute that authorizes, or (2) there is a finding by the court that the matter was frivolous.

Good luck.
