You can sue the man in district court if damages are less than $25k and in circuit court, if more. You will have to prove your case by a preponderance of the evidence.

To establish a prima facie case for battery, you must prove harmful or offensive contact to your person, intent to bring about that contact and causation.

To establish a prima facie case for assault, you must prove an act by defendant creating a reasonable apprehension of immediate harmful or offensive contact, intent to bring that about, and causation.

A reasonable person standard is used in both.

Get the police report and go from there. If will not be worth your trouble if the person is not collectible, so perhaps you can do some investigating up front of your own. If you want further assistance, contact me at [email protected].

So... this guy just came up to you last Saturday and, for no reason at all, repeatedly punched you in the face and broke your nose?

If you're suing someone for assault, you'll need more than that.
