Legal Question in Civil Litigation in Michigan

Repayment Requested

I loaned a friend $2000.00. We wrote a contract that states he would pay me back within one year and the interest would be 8%. I have been trying to collect it from him for over 2 years. We both lived in Michigan, but I have since moved to Florida. I mistakenly lost my copy of the contract. He gives me excuses everytime I call and I am in serious need of that money. What can I do? What steps should I follow? I am trying to pay for school so I have no money to hire an attorney and I have no money to return to Michigan. If anyone could please help me I would be forever in your debt (No pun intended). Thank you for your time.

Go to the small claims court in the district where the guy lives. When sued, if he denies the deal, then you have gained more than the money. You found out what a piece of s t he is. William S. Stern

You need to contact a Michigan lawyer -- or at least find out what Michigan law is. Since your contract was made in Michigan, it will be governed by the laws in that state. You may have a problem since you have lost the contract and all copies as your "friend" may now decide that his memory of the contract is different than yours. In Florida you have 5 years to sue on a written contract (4 on an oral contract). Michigan may provide for a different statute of limitations.
