Return of Engagement Ring

If an engagement was called off, is the man entitled to get the engagement ring back? The engagment was called off by the man. Can he sue to get it back?

A case came down directly on point about 1 1/2 years ago. Basically, the court said that the ring is a conditional gift and if the couple isn't married, the ring must be returned. Although, I feel this can be argued!

No. He cannot get the ring back. He of course would argue that the gift was contingent upon marrying him. However, because he broke it off, I think you have the stronger case.

As of late, Michigan courts have held that a man is entitled to have his engagement ring back if the marriage was called off, for whatever reason. Of course, if a woman gives the engagement ring, she is entitled to have it back as well. Once the marriage is official, however, the gift becomes permanent, although an annulment, instead of a divorce, might change this result.
