Legal Question in Civil Litigation in Michigan
Return of tractor
My father and cousin purchased a tractor together. Since this time my father has passed away and my cousin and his wife have divorced. The problem is the tractor is locked in the my cousins ex-wifes garage. My cousin does not care if we go and get it, but we are afraid his ex will give us a hard time. My mother has all the paper work on the tractor and we were wondering do we have a legal right to this tractor and how would we go about getting the tractor.

Re: Return of tractor
How long ago was the tractor left there, as it could be deemed abandoned. I would suggest hiring a lawyer to mediate the situation, such as by contacting the ex-wife via telephone or letter in an attempt to amicably obtain the tractor from her. You do not want to get charged with trespassing or theft, even if you have the paperwork showing ownership, as your situation is a little complicated and the police might not want to get involved in "domestic" situations.
