Legal Question in Civil Litigation in Michigan

Seizure of Money From the Goverment

Seizure of Money. The United States Government has found a corporation guilty and have fined them 6.6 million dollars for the exact same violations that they have committed against my corporation. The Government has not incurred damages but has obtained the money. What is the best way to file a complaint for seizure or attachment of this money.

Thanks for your help

Re: Seizure of Money From the Goverment

There's not such thing is simply filing a complaint to get part of a fine levied by the government, unless the government specifically litigated on behalf of a class and you were a part of that class.

You would have strong evidence for your own action (file a FOIA request) ASSUMING (and it's a big assumption), you have a nearly identical basis for private suit damages as that used by the government for levying the fine.

Often, the government can levy fines even though a private litigant would bot be able to obtain the same result on her own.

At this level of money, you should hire a lawyer and have that person investigate your rights in this matter.

Even if you do have a right to some of this money (doubtful on the facts you've given here), there would be paperwork to file and lots of proofs that need making before you would get any of it.
