Sex Offender Registery when there is an expungement
I was convicted of CSC - the lowest level - a misdemeanor - 13 years ago. I was granted an expungement last year, however I am still on the State's registry. I have an attorney filing a class action lawsuit against the State of Michigan. How can I be on the registry when legally there was no conviction?? Two days ago I was kicked out of a 2 year nursing program because suddenly they decided they could not place me in hospitals for my clinical studies. First -they knew about the registry when they admitted me to the program. Second - I have completed 2/3 of the program. Why kick me out now? I think they hired a new Dean, but they claim their contract with the hospital changed. I plan to sue them for not only past tuition, but also wages lost (I've been going to school full time) and for pain and suffering. I am the father of 3 children. This happened yesterday - what should I do today? I want to complete the program. I have invested a great deal into this. AND, the school knew all about the registry when they admitted me to the nursing program. I have done 9 months of clinical work at the hospital already. I can't believe this is happening.

My guess is that they will hang their hat on an improper answer to a question, such as whether or not you were ever arrested. The expungement does not get rid of the arrest, for example. I had this happen to a guy on the bar exam and we had to jump through some hoops to fix it. You need to hire a good lawyer. It's difficult to repair but who knows? William S. Stern
