Legal Question in Civil Litigation in Michigan
Can we be sued if...
My husband Uncle Has moved in with us. He has parkensons and has lost his license. He is still driving. Can we be sued because he lives in our home if he is in a accident?

No, not unless you let him drive your car.

If he's driving your car, absolutely.

You can only be sued or held liable if is driving a car which is in your name or insured by you. Also, if he takes your keys and uses your car, even without your permission, it may be "presumed" he had your permission since you reside together, so you might want to keep an eye on that to protect yourself.
If the situation persists and he truly is a danger on the road and will not stop driving, you need to take his car away and/or petition the court to become his guardian so you have actual legal authority to make those decisions (I went through the same thing with my grandpa - he was blind, but insisted on driving all the time).
If you need help with being appointed guardian and/or conservator, please let me know, as I do probate work.
Thanks and good luck.
