I am being sued... Is this right? What do I do?
My mother decided that she is suing me. This is why. She is on disability and she told me that she couldn't have a checking account, so I told her that I have one that she could use it to make her house payment. So I wrote her a check for $858.44 She gave me cash and I put it in my account. I mailed the check the same day. It wasn't fast enough, she called my bank and had it canceled. Then did check by phone. With a check # that I already mailed out to pay my bills. Mind you I already had roughly $500 in my account. A week later I called her and said did the check clear yet? She said yes. So I went and got my checkbook and my debit card back from her. Then I went and withdrew my $340 . Next thing I know she calls me and says that it was never payed. The money was gone. I told her that I will figure it out. In the mean time she has no job so I said if she needs money I will help. I got my monthly statement a bunch of charges I didn't do. The only one like I said was the 340. Now I got served and it says that I'm being sued for $933.00 and she said that I am mentally incompetent. What can I do? And what does it mean when she feels I 'm mentally incompetent?

You can either go to a mediation center and get some help walking through the statements and negotiating what to do, --or take your chances in court. Money doesn't just disappear.
Many small claims judges will give you the opportunity to mediate your case if you ask for an adjournment.
Mediation often helps instead of airing dirty laundry in court, you get to work it out like adults.
