Legal Question in Civil Litigation in Michigan
Sued in small claims court for a purchase from a guy and his sister sued me.
My husband bought a car three years ago from a private party. He didn't pay the car in full and was taken to small claims court by the sister of the guy that he bought it from. She didn't have a receipt of sale, only a copy of a check that was the down payment. How is it possible that she sued (and won) when she had nothing to do with the transaction? I don't deny that he owes this money to the guy in which he bought it from, but he is in California and has made no effort to contact my husband for the money. What should we do now? how do I know that the money is actually paying the guy rather then filling up the sisters pockets? Should we appeal this?

I do not know if you can appeal the small claims judgment. However, it would seem that if you pay the judgment you would not have to pay anymore for the car.
