Legal Question in Civil Litigation in Michigan

Will I ever see my money?

3 years ago, I lent money to a friend who did some work for my at my house. He has not paid it back in full, and the work he did was awful. He has paid me in this time only $100 back of the 4,000 that he owes me. What can I do? We had a written agreement, which he signed, about the work he was to do. The other money was for a vehicle forhim, a computer and to help pay child support. Is there anything I can do legally to get this money back with the informationthat I have?

You can take him to district court and try to get a judgment against him, but if he doesn't have the money you're still stuck trying to collect on it.

To legally collect, you must first take this person to court and obtain a judgment against him. A judgment will then allow you to legally collect against him. The action would be heard in district court, and you may bring the action in the small claims division of the court (where neither party needs or is allowed to have an attorney). However, in small claims court, any potential recovery will be capped at $3,000. If you have any questions, please contact me at www.lawgreg.com
