Legal Question in Civil Litigation in Michigan
I was wondering about a problem with a seller I bought an item from on ebay. I purchased an item, noticed a discrepancy in the listing, and asked the person about it, and they agreed that it was their mistake and that they would send me what they listed me to receive. The length in inches of these (obsidian knife blade blanks), was listed at 10 1/8"... I received the three blades, as he listed and promised, but they were all under 6 inches long. I asked the seller about this, to find out if maybe I read it wrong, but the seller became irate... I have all of my correspondence with this person saved, and I maintained civility and control over my words, and my temper, despite the abuse, insults, and accusations, as well as falsifying negative feedback against me against ebay rules, and even wishing cancer on me and my family... I was TRULY hurt because I would have just dropped the whole thing if he offered some sort of explanation. I my mother has cancer, and 4 of her sisters have been battling it this last year... all at the same time... one of my aunts is going to be lucky if she lives through the month... I bought these hoping to make a present for my aunt's birthday, because it is likely the last one she will have... so returning them was out of the question. I told the person this, and when he continued to threaten me with legal action (for what I cannot figure out, because it seems he has absolutely NO case to me), but also purposely damaged my feedback with lies, and manipulation of the policies on ebay... I also asked him to stop contacting me, MULTIPLE times, and even before he started to threaten me. I turned it in to buyer protection, as per ebay standard practice, and even told THEM that I did not wish to receive a refund, but rather just to have this person leave me alone... Ebay apologized and issued me a "complimentary refund", and I would assume that they withdrew the money from the seller's account to recoup their losses. So what should I do? Can I seek compensation for abuse, verbal assault, slander, libel, harassment, etc? He blatantly spread lies about me on ebay's feedback, as well as facebook, to try do damage my account standing with the community.... I just wanted this person to go away, but it has become more than a minor inconvenience, despite all of my efforts...

There is no case here. Some people like the seller are just idiots and you should move on with your refund. Tim Klisz
