601 Waiver denial question

What are the chances that a second 601 waiver is approved if the first one was denied?

1. Husband entered USA on Danish Passport. Passport was phony. He was caught at the border entering US.

2. Released on Advance Parole but we never filed for Political Asylum. Judge accepted the �withdraw� of his application.

3. Applied for adjustment of Status I-485. Change of status not approved. He was told to file I824 and exit the country.

4. Volunteered to leave and waited for a second Interview at Consulate

5. Reentry not approved, 601 filed once it was not approved.

6. 601 denied one of the options is to re-file and prove further Extreme hardship?

What are the chances the second waiver will be approved if more proof of Extreme Hardship is enclosed on second waiver?

Hi, You can submit a second waiver but it is only worth it if you can show the hardship. Not knowing what was previously submitted or what the claimed hardship is makes it difficult to give an opinion. We can review the docs for you if you would like.
