Legal Question in Immigration Law in Michigan

Business and H1B visa

I am Canadian Citizen currently on H1B. MY GC is under process. I want to open a gift /convenience store - sole Propriety. What things I should keep in mind so that I should abide by immigration laws.

Thanks in advance.

Thank you for your inquiry. I would need to review under what category you applied for GC and the conditions of your H-1B. Please contact me for an appointment (248) 619-0065. Thanks, Carrie Cardinale

Re: Business and H1B visa

You need an additional nonimmigrant visa/status in order to work at another company. H-1B are gone for 2006.

A possible option for this type of company is an E-2 (treaty investor visa) - but it depends if you are a national of the treaty country. If you do not intend to be employed by this new company, and wish to stay as a pure investor, you do not need another visa, since you already have an H-1B.

Apparently, once you apply for Adjustment of Status, and receive your EAD, you are free to work anywhere with any company. Until then, you need to stick to nonimmigrant options.

Best Regards and Good Luck!
