Legal Question in Immigration Law in Michigan
Confused
My boyfriend was born in Canada and I'm from Argentina. He came here when he was 3 and has been here since. I came legally with a visa years ago. We were planning on marrying and applying for my adjustment of status.
He wants to go to the army, but recently he told me he's still waiting for his proof of US citizenship to arrive. He says he applied for it in July. I was confused when I heard this, because I thought he got dual citizenship from Canada and the US, since he's got one parent from each place.
I don't understand. What is going on here ?? Thanks.

I question your trust here -- why haven't yoou asked him to explain? What is going on is that your boyfriend was born of one U.S. citizen outside of the United States. If his parents registered him at the U.S. Embassy in Canada, as a U.S. citizen, then he is a citizen. However, they may not have applied for his passport because one didn't need a passport (at the time) to travel from Canada to the U.S. and vice versa. Things are different now. So what your boyfriend is probably waiting for is his approved N-600 for his Certificate of Citizenship. I would recommend that once he obtains it that he immediately apply for a U.S. passport in order to confirm the evidence of his citizenship. Also, I don't believe that your boyfriend holds dual citizenship. Hope all works out and try to be a little more trusting by asking your boyfriend, or his family, about matters such as this before you consult with an attorney. If they are truthful, it would save you a lot of headache on the wedding day! Good luck.
