Re: Immigration

The answer to your first question is maybe. And the answer to your second question is file a petition. The fact that you use the word "derive" suggest thatt you you have looked into this matter at some depth. This area of immigration law is very fact specific and is dependent upon a variety of factors that include how your grandmother acquired citizenship, if your mother was in fact a citizen even if she did not apply for it and how long she resided in the United States. It really requries a very thorough review of these and several other factors to make a determination if you should file a petition. In analysing these types of problems I first try to determine if there has been derivation of citizenship and try to determine if it can be proven. I would be more than happy to discuss this problem with you further. Please email my office or give me a call. I will be in my office this Saturday until two o'clock or give me a call on Monday. The office extension is 366 which you will as my secretary is not in today.
