Legal Question in Immigration Law in Michigan

I am married to a US citizen this year in Sept. He is applying for my readjustment of status. We both are going to school. He makes $ 9,000 per annum from his part time job. He did not file taxes last year because he didn�t have a job. I make $12,600 per annum. I filed taxes last year. Our friend who is in the U.S. Army makes $20,470 per annum. He is my Sponsor. He is a Cannon Crewmember. The requirement for a sponsor is 125% above the poverty line for house hold of 2 is $16,500 for USCIS. So this guy meets the requirements he lives alone so this household size should not even apply to him. He got the job in June this year. Just wanted to know will he be good sponsor?

So basically my question is not filing taxes bec somebody just got a job is a big issue for USCIS?

Hello, I am not clear on your question. Who got the job last yearThe sponsor or your spouse?Another question I have is if you had work authorization while you worked last year? 2 issues -

1) 125% for a household size of 2 is 18,212 and not 16,500. Have your husband sponsor you and include your income as intending immigrant be considered household member. Friend is not a household member - I assume he is not living with you and is not related.

2) Your husband can still file the tax return - I assume it is 2009 year.
