Legal Question in Immigration Law in Michigan

US-residency application

My wife came here with a visitor visa. Then she met me (resident alien for 3 years) and married me . we now have a son. We want to know what is the best way we can apply for her staus to get fixed to permanent residency. Should I petition or work with a lawyer for a faster adjustment? Is there anything out there that would work best for me? and will she have to pay the $1000 dollar fee or not, based on the way she came in the country?

You need to obtain U.S. Citizenship in order to qualify your wife as an immediate relative. You could apply for her as the spouse of an LPR but the 2A category is backed up over 5 years. If you are here for three years as an LPR, you may be eligible for USC soon depending on how you obtained LPR. E-mail me directly, I'll arrange a one hour consult.

Hello,

You can currently petition for your wife but the delay is several years before she can apply for her green card. If you have been an alien resident for five years or more, you can apply for citizenship and that would be the quickest and easiet way to apply for your spouse. If you are a U.S. citizen she would not have to pay the fine since she entered with a visa. Using a lawyer would ensure that this very important process is done properly.
