Legal Question in Insurance Law in Michigan

my brother in law borrowed my car a month after i bought it and crashed it, now he is scared to talk to the insurance company. They want to talk to him to determine what happened and who was at fault, but is not calling them back and never made a police report. He also did not call me right away, only called a relative to help him tow it. He then disappeared, I have full coverage insurance on it with broad collision. I waited a couple weeks before notifying the insurance company because i was out of town and body shop said not to worry about incurring charges beings I am a good service customer. I cannot get my insurance company to stop passing me between different agents. My brother in law does not have insurance. What should I do? It's been about 3 weeks now since I started speaking with them and about 4 since I filed the claim online, no one responded so i called.

Place all communications in writing. Are you attempting to have the insurance company pay to have the car fixed and/or reimburse you for the vehicle if it's considered "totalled?" Claims take time to process and the delay is likely due to your brother in law's lack of communication and cooperation with the insurance company. However, the insurance company cannot escape its duty to process and pay a claim simply due to the actions of your brother in law. They are likely conducting an investigation to determine the veracity and truth of the facts of the accident. If the insurance company continues to ignore your claim, you should retain a lawyer to assist you. You should demand that your brother in law cooperate with them - why is he hiding? Sounds shady. They already know about the accident, so why can't he talk to them? Don't loan your car to people - this is what happens and then you're stuck in a mess.
