Are personnal images on a website protected?

I own a small website and have a section where I had posted personnal images to the site. The website clearly states, on the bottom of every page, that, ''You must be granted written permission from the owner of this site to use any of its content for any and all reasons.''

Yet recently, I have had a person who took image(s) from my site, did not remote link but rather uploaded a copy to his/her website, and placed it into a post which serves to defame, slander, or otherwise verbally abuse me and a few other people I know.

My question is, since this person did not get any sort of permission from me to use said image(s), does this constitute as copyright infringement under the ''Digital Millennium Copyright Act'' thus allowing me to pursue legal actions against said person?

I appears to constitute infringement and defamation.
