Legal Question in Juvenile Dependency in Michigan

Emergency custody

Hello i live in Michigan i have a question about emergency custody. The mother of my son has just recently been charged with her 2nd dui in 9 months violated her probation. They also have a child endangerment charge on her to since she brought my son to the probation office and blew the limit. Do i have grounds for emergency custody will i get it. And what charges is she most likely going to get her court date is march 31st should i go to. Please i need some advice thank you

You do have grounds for emergency custody. You may file an ex-parte motion for custody. Ex-parte means that the hearing will take place without a hearing notice so that she will not have an opportunity to respond to your claims.

As to the criminal charges, depending on the type of hearing, you may want to appear. You may contact the prosecutor to discuss your appearance. You will want to be informed of the plea entered and the sentence. Sometimes the plea and sentencing occur at the same hearing, and other times they are done separately.

It will be up to the prosecutor to decide what deal she may get. She is in serious trouble.
