In general, it is not illegal for a 21 year old and a 17 year old to have sex as long as there is consent by both parties.

That said, if one of the folks is mentally handicapped or intoxicated or physically helpless, or if it's an incestual situation, or one person used a position of authority he/she had over the other person to get the other person to submit to sex (including a teacher/student relationship), etc., then a crime may have occurred.
