Legal Question in Employment Law in Michigan
My brother is in a 3 person dental PLLC in Michigan. He owns 15% and the other two partners own the rest equally. He worked there for 6 yrs before buying in and bought in 3 years ago (9 yrs total). They has a contract that states a member can be expulsed with a 2/3 vote of members and this morning they gave him a written letter stating that he is being expulsed. The reason stated different practice philosophies. They want to enforce a strict non-compete that would force him to move. The real reason is they want to make the extra 15%. Is this legal?

The contract would dictate what happens and needs to be reviewed carefully.
Non-competes can be challenged if they are too broad, but the reasonableness is key. Have you brother seek advice ASAP.
