Legal Question in Employment Law in Michigan
I was still claiming unemployment when I started working for this company. Its a sales job, no where on my resume does it say i've done sales. I applied for a manager job but was given a sales position where I had to learn the basic but on the wrong campaign that I applied for. I work the first full week. did well. was sent home the monday of the second week because of no badge. Employer got caught in a lie when it was about background check not clearing. Had to correct that issue. came back to work. work the reminder of the at the wrong campaign and then was sent to another campaign. when arrived on the third week monday at the second campaign, was told by the leader that I wasn't suppose to be there and that the manager or my leader was suppose to call. No one did. I left anyway because of the excuse i was given about no three ppl could be there. went back to the office and was sent home by my leader to reconsider the job, my family and school before I got into the job too deep. called back that thrusday on the third week and left vm for the leader 30 minutes before to see if it was okay to come in, got no response, was already at location, couldn't decide what to do, so i went in to talk to the manager only for her to stay on her cell and told my leader to come out and talk to me. Didn't really want to talk to the leader but at that point didn't have a choice. Leader talk to the manager after he took me into the conference room. by the end of that week, i was told that I may have an issue translating english into my native tongue and cause lack of understanding. Not true. Speak english fluently and native tongue. Then further down this week, the leader told me to quit school and to focus on the job and plus I had already have past work experience with different roles and duties.
Manager blew me off and told me that she had been advise by her accountant that she doesn't have to pay anyone who doesn't produce their number even if it is her sister. Dump me with another leader to correct because she had to go take a smoke. I went into see her about my FOTC letter because they were asking about medical and the system had showed that I had started working.
By the fourth week, I work a full week again, only to be told by a different leader earlier in the week that I was going to be fired for not meeting quotes, By friday, my leader told me i was going to be fired for not meeting quotes on that day or the next day. The following tuesday when I showed up for work was ask to meet with the manager, manager said I was a no call no show for that monday, which was a holiday. manager said that everyone was told prior to leaving on friday. so how come only 5 people showed up out of the 12. then the manager said that two of the leaders were suppose to inform those who did not know, well i didn't get a call or a text. manager claim that the bonus were stated for Monday when they were really stated for Saturday because the manager was going out of town. Supposely the others were suppose to be fired too but only person quit on their own terms and the others, nothing happen, they stayed working.
I strongly don't feel that it is my fault because I was not notified by the manager nor the leaders when both of them had the opportunity to tell me. The manager when I ask about my paycheck and was going to pick it up the day i showed up for work, and the leader who I was with who was one of the people who were suppose to let the individuals who didn't know, know..
My question is should I send a redetermination letter to UIA for their decision because they acknoweldge that I deliberate ly disregard my employers interest and that I did not notified my employer in a timely manner of my absence? and would it rule in my favor for disregard of employee from the employer?
Oh by the way, if i didn't mention, I was never given a employee handbook from this employer to sign indicating what is a no call no show
