Legal Question in Employment Law in Michigan
Comments during evaluations
I would like to know if I have any recourse regarding inflammatory remarks made to me during my evaluation. I receive above average to excellent marks, however, my manager feels that her ''perception'' of me is part of my evaluation. She finds that I am intelligent and forward, therefore making my counterparts feel that I know everything. She doesn't deny that I am an expert in my field. She states that I need to put a big smile on my face and care if people talk behind my back. I am really tired of the high school mentality she has and I have reported her to her superior. To date, nothing has been done. She continues to nose around my desk, phone records and e-mails, just to find something I did wrong. The comments and behavior towards me have caused me to become depressed and look for new employment.

Re: Comments during evaluations
Part of the task of being an successful employee is the ability and willingness to take criticism. Your manager would be doing you (and herself) a disservice if she did not inform you of certain negative aspects of your evaluation. I trust she is doing this one-on-one, but she can do it in front of others as well. You should know that in business, unless she's deliberately mistreating you because of some protected characteristic such as your race, sex, age etc., you have no recourse.
By the way, if you complain to your manager's boss about this type of conduct, you shoud be prepared to leave your employment.
