Legal Question in Employment Law in Michigan
Contract Question
i started working for a dance studio 6 years ago. I quit due to work conditions 2 1/2 years ago. I had signed a training contract that stated that I could not open another studio within a 90 mile radius of there studio, and that I couldn't teach or opena studio for 7 years.
I would like to pen a dance stio 40 miles away from their studio. I would like to know if there is a away to dispute this contract. I am not sure if it is even inforcable since it says Training agreement and I was never given another contract to sign after I was done training. It says that it is expensive to train new teachers, but I was never paid during my training. Is there anyway that I can open a studio without risking a law suit.

Re: Contract Question
It is unlikely that a court would enforce this no-compete agreement as the time (7 years) and the distance (90 mile radius) appear to be excessive. Law suits can always be filed, regardless of the chances of winning, but it can be an expensive way to attempt enforcement of an
unenforceable agreement. Courts are reluctant to issue injunctions or restraining orders and money damages are difficult to prove.
