Legal Question in Employment Law in Michigan
Can I be dismissed from my job for medical reasons? I recently had a cardiac cath done and found out I have to have a triple bypass. After the procedure, the cardiothoracic surgeon's office sent a letter to my employer requesitng that I be on restrictions. My employer stated they could not accomodate my needs. They also said I did not qualify for FMLA because I had not been there a year yet (I had been there 9 months; I worked for the State of Michigan) I received a certified letter stated I was being dismissed from employment. Is this legal? I did have a union at my job; but no job now, no union. Can I grieve this, even if I was dismissed? Is there anything else I can do? I was scheduled for my surgery--now, I can't have this done. I have to wait on COBRA paperwork to continue my insurance. I have went to two cardiothoracic surgeons--both state this surgery needs to be done now. In the meantime, I am at risk at suffering a massive heart attack
