Legal Question in Employment Law in Michigan
Employment verification after settlement
I worked in a hopsital for 4 years, was stressed by the supervisor to the point that I required psychiatric help and took FMLA, then they transferred me to a different department, and told me to find another job within a year. I am a ultrasound tech and thats all I can do so I could not find another job, they asked me to leave after a year, I told them to fire me, they said they couldnt, that I should resign. So I consulted my lawyer who managed an out of court settlement for me. The problem is I cannot find another job in that field any where at all in the country, although it is a highly demanded profession. Is it because the hospital is giving me bad refernces? or can they? They promised me they wont say anything negative. But I suspect the supervisor maybe the cause. What can I do about this?

Re: Employment verification after settlement
I am an Indiana lawyer and am not familiar with Michigan's laws on defamation of character and/or employer provided references. However, I can tell you that methods exist to determine what reference is being given and I can help you with that. Also, I commonly send what I call a "cease and desist" letter under the circumstances you describe and have had some success with that.
