Non compete

My wife signed a non compete at her current employer (Clothing consignment store). She did the pricing of the used items and sales 2 Saturdays a month. This is a part time job ~$10 dollars an hour. She quit due to the stress and wants to work at a childrens clothing (new) store doing just sales part time ~12hours a wk. The former employer is threatening to sue. They won't give me a copy of the non compete but state that it is for 3 years, all retail clothing within 25 miles.

What should I do?

Your wife is entitled to a copy of the non compete (not you). She must make her request to her former emplyer in writing.

It would be unlikely that any Michigan Court would enforce the agreement as you state it.

It's also unlikely that the owner of a used clothing consignment store would have the resources to fund a lawsuit to enforce the agreement.
