regarding performance based raises

My boyfriend transfered to a new store within the same company awhile ago. The pay rate at this new store is significantly less than what he makes, but his pay transferred because he was hired in at a specific wage. Now it is time for his performance based raise. The company says he will not receive a raise comperable to what other employees receive(even though his evaluation was similar) simply because he makes more money than everyone else. Is this legal?

There is no law that requires that he be given a comparable pay raise. If your boyfriend is represented by a union, the union contract might cover this and he should talk to his union steward. If he does not have a union, he may still have some sort of written contract or policy manual that establishes his right to a raise. If there is no contract, then it may have been unfair not to give him a raise but it was not illegal.
