Legal Question in Employment Law in Michigan
It is my understanding that an employer can not ask date of birth (DOB) on an application for employment. I recently filled out such an application and attatched to the application was a release form for background checks asking for DOB and drivers license number.

Employers should ask for background information after a pending offer has been accepted. If the background check shows you've misrepresented yourself, than the offer may be withdrawn.
O f course, in today's employment climate, if you object to providing this information you won't be hired.
