Legal Question in Employment Law in Michigan
Wrongful Termination
I was fired after 9 months with a company that just gave me a perfect review on June 30. New management came in shortly after and made tons of changes. I missed 2 days for medical leave and next thing I know im fired.I know that because I was not there for 12 months FMLA does not help me, I feel I was wrongfully let go, but because it is at Will in Michigan, I am not sure how to proceed on this. I don't even know how to file a grievance against them and on what grounds I would. Also, they made me leave and would not even let me take family photos, now I assure you I was not being hostile, I was ready to leave quietly, I told them I was taking my things, they said no, they would pack them and send them to me. Aren't I allowed by law one hour to pack my personal things and sort my things out of files supervised by them prior to being kicked out the door? They even threatened to call the police and I have never done anything to make them think I was going to cause a problem! How can I get my stuff? It's been 4 days and I haven't even heard from them about when or how I will get it back.

Re: Wrongful Termination
Getting marched out is humiliating and it's amazing that companies feel it to be at all appropriate.
The rationale is that they don't want fired employees to have access to company materials a second longer than necessary, which is fair enough, but they could just as easily have someone there to help you pack your things as march you out under armed guard. Such is the power of at-will employment.
Write them a letter, certified, and ask for each of your things back. The certification should put them on notice. Then, go file unemployment immediately.
