Legal Question in Employment Law in Michigan

Wrongful Termination??

My name is SUSAN(names changed), and I have a question on behalf of my husband, JEFF. JEFF worked for a fairly large company for seven years. Last October, JEFF was fired. We believe he was fired because he ''told'' on his supervisor.STEVE the SUPERVISOR To make a long story short, his supervisor got in trouble because Jeff ''told'' on him, About a week later, STEVE ordered JEFF take an alcohol breathalyzer testfirst thing in the morning ataround 9 am. JEFF blew a .002, and was terminated per the drug and alcohol policy.JEFF was absolutely not drinking at work, nor acting as if he was under the influence.STEVE knew that my husband struggled with alcohol addiction before he ordered the test, and we believe he did this to get back at my husband for ''blowing the whistle'' on his work behavior.

Wondering if you have any recommendations for us. We just think my husband was unfairly fired and are looking for guidance. Thanks for your time!

Re: Wrongful Termination??

I see no problems with the termination here. Jeff was under the influence of alcohol at work and that violates company policy. Whether this was retaliation or not doesn't matter because the violation of policy is just that, a violation. Sorry I don't have better news for you. Tim Klisz www.kliszlaw.com
