Legal Question in Landlord & Tenant Law in Michigan
Back Rent after being moved
I moved into a apartment complex on 4/4/02 and was taken to court on 4/21/03 for non-renewal of lease and to gain possession of apartment. The owners is trying to sue for back rent for the month of april 2003 and 1/2 month of May 2003 after being moved because their management stated that I never returned the keys and they had to order the Sheriff's dept to come to the complex to be escorted to let them in the apartment.I moved as instructed by the courts on May 1 & 2, 2003.I was already obligated into another lease at that time.I call numerous time to the existing apartment complex about my deposit and never received it.I have missed many days of work trying to attend all court dates that their lawyers have asked of me and they are trying to garnish my check for these costs. There are laws that I understand that is supposed to be properly followed for any type of eviction and I never receive any of these evictions.I complained about the living conditions and nothing was ever done. the noise, fighting, and the destruction of my daughter's expensive cochlear implant device bythe tenant childe. There was many complaints about the living in the building and nothing ever happened.I'm trying to countersue but can't get any justice.

Re: Back Rent after being moved
You really need to have an attorney review this for you to determine if you have any recourse. If there is already a judgment, it may be too late. An attorney will charge you, of course, so you need to be prepared to pay attorney fees if you pursue litigation. If the judgment amount is not very high, it may be best just to pay it.
Good luck.
