Legal Question in Landlord & Tenant Law in Michigan
To begin, on Aug 4th, I had submitted and 30-days notice of leaving the apartment. I am on a month-to-month basis with my lease. Since I had missed their deadline of July 31st, my manager said I must pay for the apartment through October 1st. On Aug 12th, I received a letter in the mail that she had seen my cat in the window and it violated their no pets policy and I would have to find them a new home by Monday, Aug 17th or else I would be evicted. I have proof of submission of my 30 day notice since it was submitted via fax, in which I can obtain the fax verification form, which was prior to the letter regarding my cat. What I�m wondering is if they�re allowed to evict me after I submitted a 30 days notice for Sept 1st preferred, although they�re insisting I have to stay until Oct 1st? It doesn�t seem like it would be allowed that they�re telling me to stay but that they�re going to evict me. If it was the case, disgruntled landlords could submit an eviction on any tenant after they submitted their 30-day notice just to give them a bad rental history on their credit out of vengeance or any other reason.

There will need to be a court hearing before eviction, unless you have already missed it. You will get notice of this hearing. It will take a certain amount of time for them to get a hearing and eviction order. You should show up at this hearing and say you will leave by October 1, as this is what you had previously been told. If are willing to pay for September, the court may see this as reasonable and allow you to stay.
